ONLINE GENERAL TERMS & CONDITIONS OF SALE

These terms and conditions of sale apply to online sales from Water-to-Go Switzerland (hereinafter referred to as "Water-to-Go TM") and are intended for the attention of the end user (hereinafter referred to as "the Purchaser") who buys goods for non-business purposes. The Purchaser must always read the online general terms and conditions of sale before placing an order online. Any order implies unreserved acceptance of these terms. These online general terms and conditions of sale govern contractual relations between Water-to-Go Switzerland and the Purchaser who accepts them unreservedly as exclusively applicable, even if they conflict with any terms and conditions used by the Purchaser. It is stipulated that products are intended for personal use by the Purchaser, to the exclusion of any professional activity involving the resale of products. Water-to-Go Switzerland may amend the online sales terms and conditions at any time. Sales terms in force on the date the sale is agreed apply to current contracts.

THE CONTRACT

Purchasers placing an order on the Water-to-Go Switzerland website must be at least 18 years old and have full legal capacity or hold parental consent authorising them to place an order on the website. The contract between Water-to-Go Switzerland and the Purchaser becomes effective only if the Purchaser has placed an order online and if Water-to-Go Switzerland has confirmed this order by e-mail. The confirmation e-mail sent by Water-to-Go Switzerland constitutes the Purchaser’s acceptance of the order and thus forms the sales contract between Water-to-Go Switzerland and the Purchaser. Once the order is confirmed by Water-to-Go Switzerland, the Purchaser will no longer be able to amend or cancel the order. The right of exchange shall remain applicable. Water-to-Go Switzerland reserves the right to refuse an order placed by a Purchaser with whom it has an outstanding dispute relating to a previous order. The pictures featured on the Water-to-Go Switzerland website are for illustration purposes only and may not form the basis of any claim whatsoever on the part of the purchaser.

RETENTION OF TITLE

Water-to-Go Switzerland retains ownership of the goods delivered until full payment of the sale price has been received in compliance with the contract. The Purchaser is obliged to observe any measures taken to protect Water-to-Go Switzerland’s right of ownership. S/he authorises Water-to-Go Switzerland to register retention of title in the required format and to complete all the necessary formalities, at his or her own expense. For the duration of the retention of title, the Purchaser shall keep the goods in an appropriate condition and ensure that no infringement of Water-to-Go Switzerland’s property rights occurs.

PRICES

Prices quoted in the e-shop are in Swiss francs (CHF). They are inclusive of all taxes and do not include handling and shipment costs which will be invoiced separately. All orders are payable in Swiss francs (CHF) exclusively. Water-to-Go Switzerland reserves the right to amend its prices at any time. When an order is submitted, the price in effect on the date the order is placed, shown on the order confirmation, is applicable to this online sale. Shipping costs are automatically added to the cost of the goods ordered, based on the weight of these goods.

PAYMENT

Orders placed online may be paid for using Postfinance card or Paypal.

DELIVERY LEAD TIMES

Water-to-Go Switzerland undertakes to deliver the goods ordered as quickly as possible. The average delivery lead time for goods in stock is 1 to 6 working days following payment. These delivery lead times are indicative only and do not constitute an essential condition of sale. If, at the time the order is placed, the goods are not in stock; Water-to-Go Switzerland will inform the Purchaser at the earliest opportunity by e-mail. As soon as the goods are available for delivery, they will be shipped to the Purchaser. Water-to-Go Switzerland accepts no responsibility for delays.

RIGHT OF EXCHANGE

In the event that the Purchaser orders the wrong product, s/he is entitled to a right of exchange within ten days of the goods being received, subject to the following conditions: Any exchange must first be notified in writing to Water-to-Go Switzerland. Only fully intact, unused goods in their original packaging and ready for sale may be returned. Water-to-Go Switzerland will refund the amount(s) paid, with the exception of shipping costs. The money will be returned to the bank account corresponding to the payment card used by the Purchaser to complete the transaction. If a new item is to be dispatched as a replacement, this will be done by placing a new order though the e-shop.

RETURNS AND CLAIMS

It is the Purchaser’s responsibility to check the goods immediately on delivery and to notify any written reserves and claims regarding defects, non-compliance or damage caused in transit. Such written reserves and claims (which must include the reason(s) cited) must be sent to Water-to-Go Switzerland in writing at the earliest possible opportunity but no later than within fourteen (14) days of delivery where the complaint will be followed up.

FORCE MAJEURE

Neither party is responsible for the failure to complete the contract for reasons that are beyond their reasonable control (force majeure), notably: strikes, acts of terrorism, wars, supplier, transport or production problems, fluctuations in exchange rates, acts of public authority, natural disasters. Both parties will be entitled to a reasonable additional period in which to complete the contract, however, if such circumstances continue for more than 60 days, the contract may be terminated by giving written notice by either party, without liability for compensation.

DATA PROTECTION

It is essential to obtain and store personal information that is collected within the scope of distance selling, as this information is needed to process and deliver orders, and to prepare invoices. Such personal information is strictly confidential. Failure to disclose requested personal information implies the automatic cancellation of the order. Water-to-Go Switzerland undertakes to comply with legal provisions relating to data security and protection.

APPLICABLE LAW / JURISDICTION

All contracts are subject to Swiss law. Any dispute arising between the parties will be settled by the courts with jurisdiction in the Canton of Valais. The Vienna Convention on contracts for the international sale of goods is not applicable. The place of jurisdiction shall be the court of jurisdiction for the headquarters of Water-to-Go Switzerland in Champéry.

SSL is the abbreviation for "Secure Sockets Layer", the most widely used encryption process on the Web. GENERAL SERVICES CONDITIONS (GSC)

WATER-TO-GO SWITZERLAND WARRANTY

If an appliance marketed by Water-to-Go Switzerland proves defective, Water-to-Go Switzerland accepts responsibility for the repair of these defects, in accordance with the terms of cover specified out in its Warranty Booklet.

SERVICE / REPAIR WARRANTY

Water-to-Go Switzerland offers a replacement warranty, providing that the service is carried out at the Water-to-Go Switzerland, Champéry. Water-to-Go Switzerland does not offer a warranty for services / replacement that are not carried out at the Water-to-Go Switzerland.

REPLACEMENT REQUEST PROCEDURE

For any replacement request, please complete the replacement request at the “contact form” and follow the instructions provided. This form is available on the Water-to-Go Switzerland website http://watertogo.be/contact. If these instructions are not adhered to, Water-to-Go Switzerland reserves the right to reject the returned appliance or to charge a fee.

SERVICE/ REPLACEMENT SCHEDULE

Water-to-Go Switzerland guarantees a lead time of no more than 15 calendar days between the date the appliance is received (for service/replacement) at a Water-to-Go Switzerland. In the event that this maximum lead time is exceeded, Water-to-Go Switzerland undertakes to exchange the appliance or issue a credit note for an amount equivalent to its purchase price. Water-to-Go Switzerland is not responsible for the time taken for goods to be transported between its clients/partners and its Collection Centres (postal delays, delays due to problems with other transport companies, etc.). If this is the case, Water-to-Go Switzerland will not offer an exchange or issue a credit note.

VALIDITY

Any previous agreement relating to points addressed in these GSC, irrespective of its format, will lapse on the date these GSC come into effect. Any amendment must be made in writing. Water-to-Go Switzerland reserves the right to amend these GSC without prior notice and at any time in order to update them in line with requirements. Only the GSC valid on the date a case is notified are applicable.

JURISDICTION AND APPLICABLE LAW

In the event of a dispute, the place of jurisdiction shall be the court of jurisdiction for the headquarters of Water-to-Go Switzerland. Swiss law is applicable. The French version of these GSC shall prevail.
